Yolanda García Ruiz: The Withdrawal of Health Care from Irregular Immigrants and Medical Conscientious Objection

The economic crisis so strongly affecting some southern European countries has led to significant cuts in the system of universal public health care in Spain. Such measures particularly affect irregular immigrants and can also cause significant public health consequences.
A form of civil resistance that deserves to be analyzed is the conscientious objection of Spanish doctors who have chosen to continue attending irregular immigrants in contravention of new the rules restricting their access to the public health system and their right to health.
The aim of this paper is to analyze the new regulation which cut health care for irregular immigrants in Spain, the impact of this new regulation on the most vulnerable groups, and the response of doctors, who exercised their right to conscientious objection in relation to applying the new regulation. Finally to examine the announcement of change which came about as a consequence of international and domestic social pressure causing political risk to the Spanish National Government.

Miren Manias-Muñoz: The Impact of a Legal Framework on National Film Industry: an Approach to Basque-Language Cinema

After the incursion of the digitalisation and the Internet, new forms of cultural production, reception and consumption have come via the hands of technological convergence and the way society has adapted to that scenario. In the current context of globalisation traditional cultural conceptualisation has been modified by opening up an economic discourse based on knowledge, creativity and innovation. But how are cultural policies bringing this paradigm into their protection framework? As part of the cultural activity, cinema plays a core role contributing to the national economic competitiveness and social cohesion. However, small cinemas struggle and films made in minority languages face a lot more difficulties. This paper shows how a legal change has made a certain funding model possible for cinema in the Basque-language, suggesting that a legally binding space where a specific cultural subject is primarily recognised has become crucial for films in Basque.

Naayeli E. Ramírez Espinosa, Antonino Santiago Isidro: Procesos de Consulta Transparentes: la Construcción del Acuerdo en Las Flores, Mecatlán, Veracruz (Transparent consultation processes: Building agreements in Las Flores, Mecatlán, Veracruz)

El sistema normativo y político de la comunidad totonaca de Las Flores en el municipio de Mecatlán, estado de Veracruz en México se rige por varios principios, algunos de los cuales son el principio de la obediencia a los acuerdos comunitarios, el principio de la vida transparente, y el principio de compartir. En este documento los autores discuten estos principios y las normas que se relacionan con ellos en el contexto del derecho a la consulta indígena en México y la relevancia de establecer acuerdos con el pueblo Totonaca de Las Flores. Este artículo profundiza en el estudio del sistema normativo de esta comunidad con la finalidad última de colaborar en la realización de acuerdos entre esta localidad y los diferentes niveles de creación normativa en México y el mundo para la definición del futuro y la evolución del derecho en esta región.

The regulatory and political system of the Totonac community of Las Flores in the municipality of Mecatlán, state of Veracruz in Mexico is governed by several principles, some of which are the principle of obedience to community agreements, the principle of a transparent life, and the principle of sharing. In this paper the authors discuss these principles and the rules that relate to them in the context of the duty to consult indigenous peoples in Mexico and the relevance of establishing agreements with the Totonac people of Las Flores. This article has as ultimate aim to collaborate in the implementation of agreements between this locality and the different levels of normative creation for the definition of the future and evolution of law in this region.

Mariana Zuleta Ferrari: Trust in Legal Institutions: an Empirical Approach from a Social Capital Perspective

Over the last decades, there is a growing public perception that some of the democratic institutions and frameworks, which were once taken for granted, are now showing their flaws, inefficiencies, increasingly struggling to keep up with society’s demands and expectations. This has led to a generalized feeling of uncertainty and disappointment, resulting in a lack of trust institutions. The implications of these circumstances on legal theory cannot be overlooked; this article aims to address the problem from an innovative perspective. A unique tool is presented in this article, which proposes a methodological agenda for approaching trust in legal institutions, from the perspective of the social capital theory. To this end, different variables and social capital dynamics will be identified and discussed in relation to trust in legal institutions. The aim is to, on one hand, provide an innovative methodological contribution to better understand the trust crisis, and in particular, the public perception towards legal institutions, and on the other, expand the analysis of social capital dimensions.
