Oñatiko LSNEko mintegi sasoia apirilaren 11n hasiko da, eta lehenengo mintegiko protagonistak gazteak izango dira. Hain zuzen ere, mintegiaren gaia da haurren eskubideak eta ingurune osasungarri baten eskubidea, eta Arartekoak gai horren inguruan antolatutako ekintza baten parte hartu zuten bi gazte, Peio Chasco eta Patricia Poderós, etorriko dira Oñatira.

Arartekoak Enya Forum 2022 izeneko nazioarteko topaketa antolatu zuen, haurren eskubideen eta klima aldaketaren inguruan hitz egiteko. Hantxe izan ziren Peio eta Patricia, eta Arartekoko bulegoko Zuria Arzua izan zen koordinatzaile orokorra; Arzua ere Oñatin izango da. Beraien parte-hartzea hilaren 11n izango da, goizean, ‘Working with the European network of ombudspersons for children on climate justice for children’ izeneko aurkezpenarekin.

ENYA (European Network of Young Advisors) parte-hartze proiektua ENOC-en baitan antolatzen da, Europako Haurren Defendatzaileen sarearen baitan.

Oñatin egingo den mintegia apirilaren 11n eta 12an izango da. Irlanda, Erresuma Batua, Espainia, Barbados, Kanada, Hego Afrika eta AEBetako ikertzaile eta adituak etorriko dira. Mintegian zehar, besteak beste, honako galderei erantzuten saiatuko dira: Zer da ingurumen osasungarri bat izateko eskubidea? Zer esan nahi du horrek umearen eskubideei dagokienez? Zelan batu ditzakegu umearen eskubideak eta ingurumen eskubideak? Norantz goaz?

On 5 December, there will be a session about "AI in the Courtroom: Navigating the Maze of Ethics and Law in the Age of Artificial Intelligence". It will be held during the Master's programme, but it is open for anyone interested. For more information, send an email to master@iisj.es

The speakers will be Dota Szymborska (Poland) and Leopoldo Cruz Balbuena (Mexico). They have both studied in Oñati, both hold a PhD in Philosophy and Law, and both have a scientific interest in artificial intelligence. Professor Karina Ansolabehere has invited them to share some thoughts with the current students in Oñati.

Malena R. Maceira is a Ph.D. researcher at the Basque Institute of Criminology (IVAC - KREI) at the University of the Basque Country. Malena graduated from the University of Buenos Aires as a criminal lawyer and she holds a degree of M.A. in Sociology of Law from the International Institute of Sociology of Law, Oñati, Basque Country. She has developed her professional path at the Public Prosecution’s Office since 2015 investigating crimes related to tax evasion, money laundering, and drug smuggling. 

Abstract

This work aims to reflect how women of the Basque Country build memories. In particular, I am interested in the social group identified as "women victims of torture" in contexts of political violence suffered between the Transitional period that started in 1975 –after Francoism- to the present. In order to do so, the research design will require gathering the judges’ rulings of judicial processes initiated for claims on torture suffered –or not- by all women in the Basque Country between 1975 and the present. Among the judges’ rulings, I seek to identify how justice identifies an “objective fact” and how judges process that information. These facts will be observed from the counterpoint offered by the social groups constituted by women victims who build their counter-memory.

From a feminist epistemological perspective intersecting with the theoretical framework produced by memory studies scholars, I ask: Who are the women who denounce torture? How is the subject "woman victim of institutional torture" produced in the judicial process? How do these women victims (re)construct collective memories? What does the construction of alternative memories on the part of women respond to? How do judges produce or participate actively in the construction of memories? 

This perspective will allow me to observe if and in which way power relations exist in the practices associated with the construction of hegemonic and counter-memories and how they are resisted by Basque women. The recognition and understanding that a phenomenon such as institutional violence can affect a social group in such a way that it has to create a new counter-hegemonic discourse will allow the pacification process that Basque society is going through to be more inclusive.

Oñatiko 2019ko Adierazpena bultzatzeko III. Jardunaldiak, gaur Bilbon egin direnak, arrakasta izan dira bai ordezkaritza, bai publiko aldetik ere. Helburua bete egin da: arlo akademiko, sindikal eta administratiboko ordezkariek elkartrukea egin duten foro bihurtu dira. Elkarrizketa sozialari buruzko ikuspuntuak elkarbanatu dituzte, hura aldaketarako eta lanaren duintasunerako tresna gisa nola erabili behatuz. Jardunaldiak euskal unibertsitate guztietako eta Espainia osoko unibertsitate askotako 200 entzuleren parte hartzea izan du, baita beste erakunde eta erakunde batzuena ere.

2015en Bakearen Nobel Saria jaso zuen Tunisiako Lan Batasun Orokorreko (UGTT) Sami Tahriren parte hartzea nabarmendu da, baita Félix Peinado Espainiako LANEren bulegoko zuzendariarena eta Idoia Mendia Lan eta Enplegu sailburuordearena ere.

Tahriren mahai berean («Lan-politikak aldaketarako tresna: esperientzia arrakastatsuak») parte hartu dute Félix Peinadok; Cristina Estévez Navarro, UGTko Erakunde Politika eta Lurralde Politiketako idazkariak; eta Carlos Gutiérrez Calderónek, CCOOko Ikasketa eta Prestakuntza Sindikaleko idazkariak. Aipagarriak izan dira, halaber, Juan García Blasco (Zaragozako Unibertsitatea, CES), Julia López López (Pompeu Fabra Unibertsitatea); Imanol Zubero (UPV/EHU), eta Lourdes Íscarrek (Osalan) egindako aurkezpenak.

Lan Harremanen Kontseiluko presidente kargua uztera doan Tomas Arrieta Heras ere bertan izan da; halaber, Javier Muñecas Herreras, Euskadiko Ekonomia eta Gizarte Arazoetarako Batzordeko presidente berria ere. Nazioarteko ordezkari gisa, Helsinkiko Unibertsitateko Zuzenbide irakasle Toomas Kotkas izan da, ondorioen panelean parte hartzen.

Arratsaldean, jardunaldien osagarri gisa, mintegi bat izango da, non espainolezko eta ingelesezko aurkezpenak izango diren.

Oñatiko Adierazpena bultzatzeko ekintza

2019an, Lanaren Nazioarteko Erakundearen (LANE) mendeurrena dela eta, Eusko Jaurlaritzako Lan eta Enplegu Sailak Oñatiko Adierazpena aurkeztu zuen, Eusko Legebiltzarrak aho batez lagunduta. Dekalogo moduan, adierazpen honek nazioarteko lan-zuzenbidea eta lan-zuzenbidearen dimentsio sozial desberdinak errespetatuko dituen lan-harremanen eredu baterantz jo nahi du. Oñatiko LSNEn egin zen Adierazpenaren aurkezpena. Gaurko Jardunaldia LSNEk aitorpen hura sustatzeko antolatzen duen bigarren ekitaldia da, 2022ko azaroan 2019ko Oñatiko Adierazpena sustatzeko II. Jardunaldia egin zenetik: “Euskal ETEak lan munduan gertatzen diren eraldaketaren aurrean: enpleguaren kalitatea. erreformen testuinguruan”.

‘Inclusive Judging’

In this talk I will discuss a variety of ‘alternative’ approaches to judging which aim to be more inclusive of previously marginalised subjects, communities and experiences than traditional judging. ‘Inclusive’ judging is understood to refer not merely to opportunities for participation in legal proceedings, but a conscious effort to include the interests and experiences of those previously marginalised in the design of procedures, the assessment of evidence, the interpretation of facts, the formulation, interpretation and application of law, and in decision-making. These approaches range from techniques of inclusive judging in mainstream court process, to real and imagined examples of alternative justice process. I will finally consider the future of inclusive judging and the kinds of inclusivity most likely to have a wider impact.

 

Bio for introduction

Rosemary Hunter is Professor of Law and Socio-Legal Studies and Head of the Law School at the University of Kent. She is a well-known feminist socio-legal scholar, and her current research focuses specifically on the areas of family justice and judging and the judiciary. She is one of the founders of the ‘feminist judgments projects’, which involve rewriting judicial decisions from a feminist perspective. A number of projects have been conducted in common law countries and regional and international jurisdictions across the world, and new projects in several civil law countries and regions are under way. Rosemary has also been chair of the RCSL Working Group on Gender and Law, and a member of the governing board of the Onati Institute.
